Even if Trump is too old to be president, and even if Trump were to look and act like Biden, this is still an incredibly controversial decision as it absolutely interferes with an election.
If we let criminals escape punishment because they’re running for office then criminals will just use that to escape the law. No, allowing that traitor to skate would be controversial. The suggestion is that they get to speak freely about the trial as it goes forward and don’t have their speech limited.

Trump is absolutely capable of and willing to bully and harass judges, lawyers, witnesses, and potential jurors through the press. Gag orders are a common and normal part of trials like this and are not controversial. He can say any dumbass thing he wants once the trial is over.
