Can you do that? Or rather had it ever worked? I’ve heard of people getting out on modern analysis of evidence, but the cop that put them in there remained adamant they were the culprit and refused to apologize, and I never heard of them getting anything.
Yes they can win, if they can show something wasn’t followed or proper. It is hard to show wrongdoing but it does happen.
I wish I could find the court case but SCOTUS once said actual guilt is less important than being convicted. ( I am paraphrasing). Basically if the process was followed and fair, the conviction stands. There was some case where it was proven the man didn’t commit the crime and the courts said the state was not obligated to free him since the process was followed.
